1. Introduction and Acceptance
These Terms of Service (the "Terms") govern your access to and use of the website y2k-shop.com (the "Site"), operated by Cindy Ludwiczak, trading as Y2K SHOP. By browsing, creating an account, placing an order, or otherwise interacting with the Site, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
If you do not agree with any part of these Terms, please do not use the Site. The identity and full contact details of the Seller are set out in the final section of these Terms.
These Terms form part of an integrated contractual framework with our Privacy Policy, Cookie Policy, Shipping Policy, and Return & Refund Policy, each of which is incorporated by reference.
2. Eligibility
To place an order on y2k-shop.com, you must:
- Be at least 18 years old, or have reached the legal age of majority in your country of residence;
- Have the legal capacity to enter into binding contracts in your jurisdiction;
- Provide accurate, current, and complete information during the ordering process;
- Use the Site for lawful personal purposes only.
By placing an order, you represent and warrant that you meet all of these conditions. We reserve the right to refuse service or cancel any order if these conditions are not met.
3. The Site and Market Coverage
y2k-shop.com is an English-language e-commerce site dedicated to Y2K-inspired apparel, accessories, and jewelry. We ship worldwide.
Many of our products are produced to order rather than held in pre-manufactured stock. This print-on-demand model means an item is manufactured only once it has been purchased, which may affect production and delivery timelines as described in our Shipping Policy.
4. Products and Descriptions
We make every effort to display our products accurately, including their colors, textures, dimensions, and characteristics. However, minor variations may occur due to:
- Screen color calibration differences across devices;
- Natural variations in fabric and printed components;
- Photographic lighting and styling choices.
Product descriptions use style-inspired terminology referencing early-2000s fashion, streetwear, and pop culture aesthetics. This terminology is used for editorial and stylistic purposes only and does not imply any affiliation with, license from, or endorsement by any brand, celebrity, or cultural movement referenced.
We reserve the right to modify product descriptions, update photography, or discontinue products at our discretion, without prior notice. Such modifications do not affect orders already accepted.
5. Pre-Contractual Information
In accordance with article L221-5 of the French Code de la consommation, the following information is provided to the Customer prior to the conclusion of the contract:
- The essential characteristics of the products are described on each individual product page;
- The total price, including all taxes and shipping costs, is displayed on each product page and confirmed at checkout, in accordance with article L112-1-1 of the French Code de la consommation;
- The identity of the Seller, including legal form, address, and registration details, is set out in the final section of these Terms;
- The terms of payment, delivery, performance, and complaint handling are described in these Terms and in our Shipping Policy;
- The conditions, time limits, and procedures for exercising the right of withdrawal are described in section 8 below and in our Return & Refund Policy;
- The legal guarantees of conformity (articles L217-3 to L217-17 of the French Code de la consommation) and against hidden defects (articles 1641 to 1649 of the French Code civil) apply, and are described in section 10 below.
6. Pricing and Payment
All prices displayed on the Site are in US dollars (USD) and include all applicable taxes (VAT where relevant) and shipping costs, unless otherwise stated at checkout.
Accepted payment methods include the major credit and debit cards, and other digital payment methods that may be added or removed at our discretion, subject to availability at checkout. All payments are processed through certified third-party payment providers (Shopify Payments, PayPal, or equivalent). We do not store your full card details on our servers.
We reserve the right to decline or cancel any order if:
- Payment authorization fails;
- The order appears fraudulent or violates these Terms;
- The relevant stock or production capacity is unavailable;
- There is a manifest pricing error on the Site, in accordance with article 1132 of the French Code civil regarding error vitiating consent.
7. Order Acceptance and Formation of the Contract
Placing an order on the Site constitutes an offer by the Customer to purchase. The order is not accepted, and the contract is not formed, until we send you an order confirmation email. This confirmation marks the formation of a binding contract between the Customer and the Seller, governed by these Terms and the related policies.
In the rare event of a manifest pricing error, production issue, or suspected fraud, we may cancel the order and issue a full refund. In such cases, the Customer will be notified by email as soon as reasonably possible, and no contract will be deemed formed.
8. Right of Withdrawal
In accordance with articles L221-18 to L221-28 of the French Code de la consommation, EU Customers have a statutory right to withdraw from the contract within 14 calendar days after delivery, without giving any reason.
Y2K SHOP applies a 14-day return window from the date of delivery for all Customers worldwide. Where the statutory withdrawal period applicable in your jurisdiction is longer than 14 days, the longer period shall apply.

9. Shipping
Shipping terms, delivery times, carrier networks, customs handling, and risk transfer are detailed in our Shipping Policy, which forms an integral part of these Terms. In accordance with article L216-1 of the French Code de la consommation, we commit to delivering the goods within a maximum of 30 calendar days from the day after the order is placed.
10. Legal Guarantees
Independently of these commercial Terms, the Customer benefits from the following mandatory legal guarantees under French law, which apply to all Customers and cannot be waived:
- Legal guarantee of conformity (articles L217-3 to L217-17 of the French Code de la consommation): the Seller is liable for any lack of conformity of the goods existing at the time of delivery, for a period of two years from delivery. The Customer may choose between repair and replacement, subject to the cost conditions set out in article L217-12;
- Guarantee against hidden defects (articles 1641 to 1649 of the French Code civil): the Seller is liable for hidden defects that render the goods unfit for their intended use, or that diminish this use so much that the Customer would not have purchased, or would have purchased at a lower price, had they known. The action must be brought within two years of the discovery of the defect.
To exercise either legal guarantee, contact contact@y2k-shop.com with a description of the issue, photographs where applicable, and your order number. No additional cost is borne by the Customer for the exercise of these guarantees.
11. Returns and Refunds
Our complete return and refund terms are detailed in our Return & Refund Policy, which forms an integral part of these Terms. Key principles:
- Returns accepted within 14 calendar days after delivery;
- A prepaid return label is provided once a return request is approved;
- Items must be returned in their original condition, unused, unworn, unwashed, with original packaging where applicable;
- Refunds are issued to the original payment method, typically within 5 to 10 business days after we receive and inspect the returned items.

13. Intellectual Property
All content on the Site — including but not limited to texts, photographs, graphics, logos, designs, product descriptions, video, and underlying source code — is the property of the Seller or is used with proper authorization. Such content is protected by French and international copyright, trademark, and intellectual property laws.
You may not copy, reproduce, republish, distribute, modify, translate, or commercially exploit any content of the Site without our prior written consent. Any unauthorized use may give rise to civil and criminal liability under the French Code de la propriété intellectuelle.
Personal, non-commercial use (such as sharing a product photo on your own social media with proper credit to Y2K SHOP) is permitted within the limits set by applicable law.
14. User-Generated Content and Reviews
When you submit reviews, photographs, comments, or any other content through the Site, you grant the Seller a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, display, distribute, and adapt that content for marketing, operational, and editorial purposes, for the duration of legal protection of the content. You retain ownership of your content and the right to publish it elsewhere.
You represent and warrant that:
- Your content is original and does not infringe any third-party rights;
- Your content is honest and based on genuine experience with our products;
- Your content is respectful and does not contain unlawful, defamatory, discriminatory, or offensive material;
- You have obtained any necessary consent from third persons identifiable in your content (e.g. for photographs).
We reserve the right to moderate, edit, or remove any content that violates these rules. Our review system complies with articles L111-7-2 and L121-4 of the French Code de la consommation and with the FTC Endorsement Guides regarding online reviews.
15. Prohibited Uses
You agree not to use the Site for:
- Any unlawful purpose or to violate applicable national, international, or EU laws;
- Harassing, defaming, impersonating, or otherwise harming other users or third parties;
- Uploading viruses, malicious code, or attempting to breach the security of the Site or its underlying infrastructure;
- Collecting user or pricing data through automated means (scraping, crawling, bots) without our prior written authorization;
- Misrepresenting your identity, payment information, or shipping address;
- Commercial resale of our products without our prior written consent;
- Any action that may damage, disable, or impair the Site or interfere with other users' use of the Site.
Violation of these rules may result in immediate suspension or termination of your access to the Site and may give rise to civil or criminal proceedings.
16. Disclaimers and Limitation of Liability
To the maximum extent permitted by applicable law, the Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind beyond those required by mandatory consumer protection law. We make no warranty that the Site will be uninterrupted, error-free, or free from harmful components.
To the maximum extent permitted by applicable law, the Seller shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or the products, including loss of profits, loss of data, loss of business opportunities, or third-party claims, except in cases of fraud or gross negligence on our part.
Our total cumulative liability for direct damages arising from a single order shall not exceed the total amount paid by the Customer for that order.
Nothing in these Terms limits or excludes liability for death, personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot be excluded under applicable mandatory consumer protection law. In particular, the legal guarantees described in section 10 above and the Customer's statutory rights under French and EU consumer law remain fully applicable.
17. Force Majeure
In accordance with article 1218 of the French Code civil, neither party shall be held responsible for any delay or failure to perform resulting from events of force majeure — that is, events beyond the affected party's reasonable control that could not have been reasonably foreseen and whose effects cannot be avoided by appropriate measures. Such events include, without limitation: natural disasters, pandemics and related government restrictions, wars, acts of terrorism, strikes affecting carriers or postal services, customs disruptions, and governmental actions preventing performance.
In such cases, the affected party will notify the other within a reasonable timeframe, and obligations will be suspended for the duration of the event. The Customer's statutory right to terminate the contract under article L216-6 of the Code de la consommation in case of delivery exceeding 30 calendar days remains fully applicable.
18. Personal Data and Privacy
The processing of personal data in connection with your use of the Site and any order is governed by our Privacy Policy and complies with the EU General Data Protection Regulation (Regulation EU 2016/679 — GDPR), the French Loi Informatique et Libertés as amended, the UK Data Protection Act 2018, the California Consumer Privacy Act (CCPA/CPRA), and other applicable data protection laws. By using the Site, you acknowledge having read and understood our Privacy Policy.
19. Dispute Resolution
In the event of a dispute, the Customer is encouraged to contact us first at contact@y2k-shop.com so that we can seek an amicable resolution. We commit to acknowledging any complaint within 48 hours and to providing a substantive response within 14 calendar days.
For Customers in the European Union, the European Commission provides an Online Dispute Resolution (ODR) platform, accessible at: https://ec.europa.eu/consumers/odr. This platform allows consumers and traders to settle online disputes out of court.
For Customers in the United States, alternative dispute resolution may be available through your State Attorney General's office, the Better Business Bureau (BBB), or via small claims court within your state's jurisdictional limits.
Nothing in this section limits the Customer's right to bring proceedings before a competent court.
20. Governing Law and Jurisdiction
These Terms are governed by French law. They complement — and do not limit — any mandatory consumer protection rights applicable under the Customer's local law.
For Customers residing in France, any dispute concerning the formation, interpretation, performance, or termination of these Terms shall, in the absence of an amicable resolution, fall under the jurisdiction of the competent French court applying the rules of article R631-3 of the French Code de la consommation (typically the court of the Customer's domicile, the court of the place of delivery, or the court of the Seller's registered office, at the Customer's choice).
For Customers residing outside France, the Customer's mandatory local consumer protection rules remain fully applicable. Any dispute may be brought, at the Customer's choice, before the courts of their place of residence or before the competent French courts.
21. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent court or regulatory authority, the remaining provisions shall remain in full force and effect. The invalid provision shall be deemed replaced by a valid provision reflecting as closely as possible the original intent.
22. Modifications to the Terms
We reserve the right to modify these Terms at any time, in particular to reflect changes in our practices, in applicable laws, or in our business operations. Changes become effective upon publication on this page. For orders already placed and confirmed, the version of these Terms in force on the date of the order will continue to apply to that specific order. Material changes will be communicated by reasonable means (notice on the Site or email to registered users) before taking effect.
23. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between the Customer and the Seller regarding the use of the Site and the purchase of products. They supersede any prior agreement, communication, or understanding between the parties on the same subject matter.
24. Language
These Terms are drafted in English for the international market served by y2k-shop.com. In the event of a conflict between this version and any translation, the English version shall prevail, except where mandatory consumer protection law requires the application of a translated version.
